Purchase-Sale Rules

  • 1. General Provisions.
    1.1. These goods purchase-sale rules (hereinafter – the Rules) are a binding legal document for the Parties, which establishes the rights, obligations, and responsibilities of the Buyer and the Seller when the Buyer purchases goods in the online store www.mmirror.eu.
    1.2. The Seller reserves the right to change, correct or supplement the rules at any time, taking into account the requirements established by legal acts. The Buyer is informed on the online store's website. When the Buyer shops in the online store, the Rules valid at the time of placing the order apply.
    1.3. The right to shop in the online store is granted to:
    1.3.1. capable natural persons, i.e., persons who have reached the age of majority and whose capacity is not restricted by court order;
    1.3.2. minors aged 14 to 18 years, only with the consent of their parents or guardians, except in cases where they independently dispose of their income;
    1.3.3. legal entities;
    1.3.4. authorized representatives of all the above-mentioned persons.
    1.4. The Seller, by confirming the rules, also guarantees that, according to clause 1.3 of the rules, the Buyer has the right to purchase goods in the online store.
    1.5. The contract between the Buyer and the Seller is considered concluded from the moment the Buyer, having formed a shopping cart in the online store, specified the delivery address, chosen the payment method, and familiarized themselves with the Seller's rules, clicks the "Confirm Order" button (see clause 5 "Goods ordering, prices, payment procedure, terms").
    1.6. Each contract concluded between the Buyer and the Seller is stored in the online store www.mmirror.eu

     

    2. Protection of Personal Data.
    2.1. The Buyer can order goods in the online store by:
    2.1.1. registering in the online store


    3. Buyer's Rights and Obligations.
    3.1. The Buyer has the right to purchase goods in the online store in the manner established by these Rules and other information sections of this online store.
    3.2. The Buyer has the right to withdraw from the goods purchase-sale contract with the online store by notifying the Seller in writing (by email, specifying the desired item to be returned and its order number) no later than within 14 (fourteen) working days from the date of delivery of the item, except in cases where the contract cannot be withdrawn according to Lithuanian laws (e.g., when the contract is concluded for the sale of hygiene goods – bedding; see information on the website of Public Institution "Consumers' Centre" "Peculiarities of return and exchange of non-food products", clause 18).
    3.3. The Buyer may exercise the right provided in clause 3.2. of the Rules only if the item has not been damaged or its appearance has not substantially changed, and it has not been used.
    3.4. The Buyer undertakes to provide a correct address and contact details necessary for the delivery of the item(s), to accept the ordered items, and to pay the agreed price for them.
    3.5. If the data provided by the Buyer in the registration form changes, the Buyer must update them without delay.
    3.6. The Buyer undertakes not to disclose their login details to third parties. If the Buyer loses their login details, they must immediately inform the Seller using the contact methods specified in the "Contacts" section.
    3.7. By using the online store, the Buyer agrees to these purchase-sale Rules and undertakes to comply with them and not to violate the legal acts of the Republic of Lithuania.

     

    4. Seller's Rights and Obligations.
    4.1. The Seller undertakes to create all conditions for the Buyer to properly use the services provided by the online store.
    4.2. If the Buyer attempts to harm the stability and security of the Seller's online store or violates their obligations, the Seller has the right to immediately and without warning restrict or suspend the Buyer's ability to use the online store or, in exceptional cases, cancel the Buyer's registration.
    4.3. The Seller undertakes to respect the Buyer's right to privacy regarding the Buyer's personal information provided in the online store's registration form.
    4.4. The Seller undertakes to deliver the goods ordered by the Buyer to the address specified by the Buyer in Lithuania (excluding the Curonian Spit, where delivery conditions may differ due to the terms provided by logistics companies).

     

    5. Order of Goods, Prices, Payment Procedure, Terms.
    5.1. In the online store

     

    6. Goods Delivery.
    6.1. The Buyer, having chosen the goods delivery service during the order, undertakes to specify the exact delivery location of the goods.
    6.2. The Buyer undertakes to accept the goods personally. In cases where the Buyer cannot accept the goods personally, and the goods are delivered to the specified address, the Buyer has no right to make claims to the Seller regarding the delivery of goods to an unsuitable recipient.
    6.3. The goods are delivered by the Seller or an authorized representative of the Seller (courier).
    6.4. The Seller delivers the goods to the Buyer in accordance with the terms specified in the goods descriptions. These terms are preliminary and do not apply in cases where the Seller's warehouse does not have the required goods, and the Buyer is informed about the shortage of ordered goods. At the same time, the Buyer agrees that in exceptional cases, the delivery of goods may be delayed due to unforeseen circumstances beyond the Seller's control. In such a case, the Seller undertakes to immediately contact the Buyer and agree on the terms of goods delivery.
    6.5. In all cases, the Seller is released from liability for violating goods delivery deadlines if the goods are not delivered to the Buyer or are delivered late due to the Buyer's fault or due to circumstances beyond the Seller's control.
    6.6. The Buyer must in all cases immediately inform the Seller if the shipment is delivered in a crumpled or otherwise damaged package, if the shipment contains unordered goods or an incorrect quantity, or an incomplete set of goods.
    6.7. In all cases, upon noticing packaging damage during delivery, the Buyer must make notes on the shipment delivery document provided by the courier or draw up a separate act regarding these damages. The Buyer must do this in the presence of the courier. If such actions are not performed, the Seller is released from liability to the Buyer for goods damage related to packaging damage that the Buyer did not note in the courier's goods delivery document.

     

    7. Goods Quality, Warranties.
    7.1. The data of each product sold in the online store www.mmirror.eu are generally indicated in the product description next to each product.
    7.2. The Seller is not responsible for the fact that the goods in the online store www.mmirror.eu may not match the actual size, shapes, and colors of the goods in terms of color, shape, or other parameters due to the characteristics of the display used by the Buyer.
    7.3. The Seller provides a quality guarantee valid for a certain period for certain types of goods, the specific term and other conditions of which are indicated in the descriptions of such goods.
    7.4. If the Seller does not provide a quality guarantee for certain types of goods, the guarantee provided by the relevant legal acts applies.

     

    8. Return and Exchange of Goods.
    8.1. Defects of sold goods are eliminated, defective goods are exchanged, and returned in accordance with applicable laws of the Republic of Lithuania and other legal norms and documents, except in cases where the contract cannot be withdrawn according to the laws of the Republic of Lithuania (when the contract is concluded for the sale of hygiene goods – bedding; see information on the website of Public Institution "Consumers' Centre" "Peculiarities of return and exchange of non-food products", clause 18). Money for returned goods is in all cases transferred only to the payer's bank account.
    8.2. To return goods in accordance with clause 8.1. of the Rules, the Buyer may do so within 14 (fourteen) working days from the date of delivery of the goods to the Buyer, by informing the Seller using the contact methods specified in the contact section, indicating the name of the returned goods, the order number, and the reasons for return.
    8.3. When returning goods, the Buyer must comply with the following conditions:
    8.3.1. the returned goods must be in their original, undamaged packaging;
    8.3.2. the goods must not be damaged by the Buyer;
    8.3.3. the goods must be unused, not have lost their commercial appearance (undamaged labels, unpeeled protective films, etc.) (this point does not apply when defective goods are returned);
    8.3.4. the returned goods must be of the same complete set as received by the Buyer;
    8.3.5. when returning goods, it is necessary to provide the document of purchase.
    8.4. The Seller has the right not to accept goods returned by the Buyer if the Buyer does not comply with the goods return procedure established in Article 8.3.
    8.5. If the wrong goods and/or defective goods are returned, the Seller undertakes to retrieve such goods and replace them with analogous suitable goods.
    8.6. In cases where the Seller does not have suitable goods for exchange, the Buyer is refunded the amount paid.

     

    9. Responsibility of Buyer and Seller.
    9.1. The Buyer is solely responsible for the accuracy of the personal data provided by the Buyer. If the Buyer does not provide accurate personal data in the registration form, the Seller is not responsible for the consequences arising therefrom and acquires the right to claim compensation for direct losses incurred from the Buyer.
    9.2. The Buyer is responsible for actions performed using this online store.
    9.3. The registered Buyer is responsible for transferring their login details to third parties. If the online store

     

    10. Marketing and Information.
    10.1. The Seller may, at its discretion, initiate various promotions in the online store www.mmirror.eu.
    10.2. The Seller has the right to unilaterally, without separate notice, change the terms of promotions, as well as cancel them. Any change or cancellation of promotion terms and procedures is valid only prospectively, i.e., from the moment they are made.
    10.3. The Seller sends all notifications by the contact means specified in the Buyer's registration form.
    10.4. The Buyer sends all notifications and questions to the Seller's online store using the phone numbers and email addresses specified in the "Contacts" section.
    10.5. The Seller is not responsible if the Buyer does not receive sent informational or confirmation messages due to internet connection or email service provider network disruptions.

     

    11. Final Provisions.
    11.1. These goods purchase-sale Rules are drawn up in accordance with the laws and legal acts of the Republic of Lithuania.
    11.2. All disputes arising from the execution of these Rules shall be resolved by negotiation. If an agreement cannot be reached, disputes shall be resolved in accordance with the procedure established by the laws of the Republic of Lithuania. www.mmirror.eu

    9.4. The Seller is exempt from any liability in cases where losses arise due to the Buyer, disregarding the Seller's recommendations and the Buyer's obligations, not having familiarized themselves with these Rules, although such an opportunity was provided to them.
    9.5. If the Seller's online store contains links to the electronic websites of other companies, institutions, organizations or individuals, the Seller is not responsible for the information or activities carried out there, does not supervise or control those websites, and does not represent those companies or individuals.
    9.6. In the event of damage, the culpable Party compensates the other Party for direct losses.

    7.3. The Seller provides a quality guarantee valid for a certain period for certain types of goods, the specific term and other conditions of which are indicated in the descriptions of such goods.
    7.4. If the Seller does not provide a quality guarantee for certain types of goods, the guarantee provided by the relevant legal acts applies.

    5.2. The contract becomes effective from the moment the Buyer clicks the "Confirm Order" button, and after receiving the order, the Seller confirms it by sending a confirmation email to the email address provided by the Buyer.
    5.3. Prices of goods in the online store www.mmirror.eu

    5.4. The Buyer pays for the goods in one of the following ways:
    5.4.1. payment using online banking – this is an advance payment using the Buyer's online banking system. The Buyer, wishing to use this payment method, must have concluded an online banking agreement with one of the banks. The Buyer transfers money to the online store's settlement account. Responsibility for data security in this case lies with the respective bank, as all monetary transactions take place within the bank's online banking system.
    5.4.2. Payment by bank transfer – this is an advance payment when the Buyer, after printing the order and going to the nearest bank branch, transfers money to the online store's bank account.
    5.5. The Buyer undertakes to pay for the goods immediately. Only after receiving payment for the goods, the goods shipment is formed, and the goods delivery period begins to be calculated.

When ordering goods in the ways provided for in clause 2.1 of the rules, the Buyer must provide the personal data necessary for the proper fulfillment of the goods order in the relevant information fields provided by the Seller: name, surname, goods delivery address, telephone number, and email address.
    2.3. By confirming these rules, the Buyer agrees that the personal data of the Buyer provided in clause 2.2 will be processed for the purposes of selling goods and services in the online store, analyzing the Seller's activities, and direct marketing.
    2.4. By agreeing that the Buyer's personal data will be processed for the purpose of selling goods and services in the Seller's online store, the Buyer also agrees to receive informational messages necessary for the fulfillment of the goods order to the email address and phone number provided by the Buyer.
    2.5. By registering in the online store and ordering goods, the Buyer undertakes to keep login data secure and not disclose it to anyone.
